3. Consumers and Non-consumer Buyers

A consumer is a natural person who, when entering into the contract, acts outside their business, trade, profession or employment.

A non-consumer buyer is, in particular, a legal entity or a natural person purchasing the book in connection with their business or professional activities.

The provisions of these terms concerning specific consumer rights apply only to consumers. Other buyers are subject to the applicable legislation and the remaining provisions of these terms.

4. Formation of the Contract

Orders are placed through the SimpleShop ordering system.

Before submitting an order, the buyer can review and correct the information entered. The buyer must provide accurate, complete and up-to-date information, particularly a correct email address.

The contract is concluded in Slovak. The order becomes binding once it has been submitted using the button labelled "Order with obligation to pay" and an automatic order confirmation has been delivered to the buyer's email address.

The order confirmation includes the product details, price, payment instructions and information concerning the supply of the digital content.

5. Price

The price of the book is €39. The seller is not registered for VAT; therefore, no VAT is added to the price.

The final price will be displayed to the buyer before the order is submitted. No postage or other delivery charge applies to electronic delivery.

If a valid discount code is used, the final price will be displayed before the order is submitted. The conditions and validity period of the code are stated in the relevant offer.

6. Payment Terms

Payment is made by bank transfer using the details provided in the order confirmation.

The seller's bank details are:

IBAN: SK23 8330 0000 0021 0356 4377
SWIFT/BIC: FIOZSKBAXXX

The buyer must enter the correct payment reference (variable symbol) or other payment identifier specified in the order. An incorrect reference may delay payment matching and delivery of the book.

7. Supply of Digital Content

The book is delivered electronically to the email address provided by the buyer.

Once payment has been credited and matched to the order, the system will send the buyer a download link. The digital content will be supplied without undue delay after payment has been matched.

The link permits a maximum of three downloads. After downloading, the buyer must store the file securely and keep a backup copy.

The digital content is considered supplied when it has been made available to the buyer or to an electronic device chosen by the buyer, and the buyer has obtained access to it.

If the buyer does not receive the book after payment, they must check their spam or junk folder and then contact the seller at kniha@gastrobratia.sk or on +421 904 278 238.

8. Immediate Supply and the Consumer's Right of Withdrawal

For contracts concluded at a distance, consumers generally have the right to withdraw from the contract within 14 days without giving a reason.

For digital content supplied without a physical medium, the consumer loses this right when the supply of the digital content begins, but only if:

  1. The consumer has given express consent to the supply beginning before the end of the 14-day withdrawal period.
  2. The consumer has acknowledged that they have been duly informed that, by giving this consent, they will lose their right of withdrawal once supply begins.
  3. The seller has provided confirmation of the concluded contract on a durable medium.

The consumer must give consent by actively ticking a separate checkbox. The checkbox must not be pre-ticked.

If the consumer does not give separate consent to immediate supply, they may contact the seller and request supply after the 14-day withdrawal period has expired.

The loss of the right to withdraw without giving a reason does not affect the consumer's rights concerning defective digital content.

9. Licence and Copyright

The book and its content are protected by copyright.

By purchasing the book, the buyer receives a non-exclusive, non-transferable licence, without territorial restriction, to use one copy of the book for their own internal purposes.

Without the author's prior written consent, the buyer must not, in particular:

  • Resell the book.
  • Make it available to third parties.
  • Publish the book or a substantial part of it online.
  • Upload it to a publicly accessible storage service.
  • Distribute copies by email or any other means.
  • Remove authorship or copyright notices.
  • Create and distribute unauthorised derivative materials.

A corporate buyer may make the book available to its employees within a single legal entity solely for internal work purposes. Making it available to external contractors, other companies or the public is not permitted.

10. Content of the Publication

The publication is professional, educational and informational in nature. It does not replace individual legal, tax, accounting, food hygiene, health or microbiological advice.

Readers must adapt the procedures to the circumstances of their establishment and verify them against current legislation, decisions of public authorities, their approved HACCP system and their specific technological conditions.

The seller is not liable for damage resulting from the use of the content contrary to applicable legislation, professional standards, manufacturers' instructions or the specific conditions of the establishment. This does not affect any consumer rights that cannot lawfully be excluded or restricted.

11. Liability for Defects

The seller is responsible for ensuring that, at the time of supply, the digital content conforms to the agreed description, quantity, quality, functionality, compatibility and other agreed characteristics.

For digital content supplied in a single act of supply, the seller is liable to the consumer for any defect that becomes apparent within two years of supply.

The author's professional opinion, the buyer's disagreement with the content, or the buyer's expectation of information or functionality that was not included in the product description does not constitute a defect.

If the file cannot be downloaded, is corrupted or cannot be opened despite the use of a compatible device and software, the buyer is entitled to request a remedy.

12. Complaints

Complaints may be submitted:

By email: kniha@gastrobratia.sk
By telephone: +421 904 278 238
In writing: Štefan Krajčovič, J. Poničana 2413/59, 960 01 Zvolen, Slovak Republic

The buyer should provide their name, the email address used for the order, the order number, a description of the defect and, where possible, a screenshot or error message.

The seller will acknowledge receipt of the complaint without delay on a durable medium. The seller aims to respond to messages within 48 hours. This is a target for the initial response, not the statutory deadline for resolving the complaint.

The seller will remedy the defect within a reasonable period, which will not exceed 30 days from notification of the defect, unless a longer period is justified by an objective reason beyond the seller's control.

Further details are provided in the Complaints Policy.

13. Alternative Dispute Resolution for Consumer Disputes

If a consumer is dissatisfied with the handling of their complaint or believes that the seller has infringed their rights, they may submit a request for redress to the seller.

If the seller rejects the request or does not respond within 30 days, the consumer may submit an application to initiate alternative dispute resolution.

15. Final Provisions

These terms and conditions are governed by the laws of the Slovak Republic.

The seller may amend these terms and conditions. Each order is subject to the version in effect at the time the order is submitted.
